This action was originally commenced in the district court of Tulsa county by Lois Lee Harman against the city of Tulsa to recover damages because of the death of her husband, William Gil bert Harman, alleged to have been caused by and through the negligence of the defend'-, ant. The trial was to a jury, resulting in a verdict in favor of defendant. Hereafter the defendant in error will be referred to as plaintiff, and the plaintiff in error as defendant, this being their position in the trial court.
