This is a proceeding to determine whether the relators or the defendants are entitled to exercise the power and authority vested in the board of commissioners of The Port of Portland. The questions involved relate to the construction and sufficiency of the title of the act of 1903, which act purports to invest the relators with such power and authority, and, if valid, displaces the defendants, who constitute the present board.
