MEMORANDUM OPINION

WALTON, District Judge.

On March 9, 2005, the plaintiffs filed this action seeking to prevent the defendants from further using their images in an advertising campaign which challenged various public policy positions taken by the American Association of Retired Persons (“AARP”) regarding Social Security reform and the military. Complaint (“Compl.”) ¶ 1.
