AMENDED MEMORANDUM OPINION

Hearing was held on May 30, 2001, on the motion of plaintiff Wachovia Bank, N.A. for summary judgment as to defendant Joseph E. Beck, III.

For reasons stated in this opinion, the court will grant plaintiffs motion for summary judgment as there are no material issues in dispute.
