The plaintiffs, Mark and Tara Casavant, brought an action against Norwegian Cruise Line Ltd. (Norwegian), seeking a refund for two cruise tickets they purchased and cancelled, and damages under G. L. c. 93A for unfair and deceptive trade *501practices. A Superior Court judge granted Norwegian’s motion to dismiss the Casavants’ complaint on the grounds of a forum selection clause in the “contract of passage.” The Appeals Court reversed and remanded the case for trial.
