At the time here in question, the defendant, Bernard Robbins, being the owner, inter alia, of a certain subdivision of land located near Miami, Florida, called “Granada Park,” on February 11, 1926, entered into a written contract with the plaintiff, W. T. Price, Inc., for the pavement of streets and sidewalks in the subdivision, at a fixed price per square yard for the streets and per square foot for the walks.
