Error from Wilson District Court. Ejectment, brought by Hudson against Russell and others, to recover the possession of certain real estate in Wilson county. Trial at the May Term, 1881, of the district court, and judgment for plaintiff. Russell brings the case here. The facts are stated in the opinion.

This was an action of ejectment, brought by Isaac Hudson against Henry E. Russell and others, for the recovery of certain real estate in Wilson county, Kansas. Judgment was rendered in favor of the plaintiff and against the defendant, Russell, for the recovery of the property; and the defendant, Russell, took the case to the supreme court, where the judgment of the court below was reversed, and the cause remanded for further proceedings.
