Eggleston v. Advance Thresher Co.
Supreme Court of Minnesota
Action in the district court for Nobles county to recover $800 and interest, for the conversion of certain personal property. The case was tried before P. E. Brown, J., and a jury, which rendered a verdict in favor of plaintiffs for the sum demanded. From an order denying a motion for judgment notwithstanding the verdict or for a new trial,, defendant appealed.

The facts in this case are as follows: During the years 1901, 1902, and 1903, one Shanahan was defendant’s agent at Worthington, Minnesota, for the sale of its threshing machines and other farm implements, and his appointment and authority as such were embodied in a written contract (Exhibits “B 1” and “B 2”) which specifically stated and fixed the terms of the agency.
