In 1980, defendant-appellant Alphonse Pérsico and co-defendant Michael Bolino were tried before the United States District Court for the Eastern District of New York, Weinstein, J. The indictment against them charged that they conspired to make an extortionate extension of credit in violation of 18 U.S.C. § 892 (1982) (count one), conspired to collect an extension of credit by extortionate means in violation of 18 U.S.C. § 894 (1982) (count two), and collected an extension of credit by extortionate means in violation of 18 U.S.C. §§ 2, 894 (1982) (count three).
