OPINION

I. Introduction

Before the Court is Defendant’s Motion to Dismiss (hereinafter “Def.’s Mot.”), alleging lack of subject matter jurisdiction under Rule 12(b)(1) of the Rules of the United States Court of Federal Claims (hereinafter “RCFC”). Def.’s Mot. at 1. In its motion, Defendant alleges that the Court cannot hear Plaintiff’s claim, which asserts breach of a plea bargain, because the Court of Federal Claims has no jurisdiction over agreements made within the criminal justice system.
