The record in this case is meager, but it seems therefrom that the question presented by the appeal arose in this way: There was an action pending in the district court of Stephens county, styled Hanbury, Russell Supply Co. v. L. H. Harvey and Steve Linson, and this action was consolidated with the case of W. E. Farrell v. L. H. Harv'ey, in which cause several other parties were interpleaded.
