This case presents error from the district court of Lincoln county. S. W. Beatty, Sr., died intestate in Lincoln county on the 5th day of May, 1913, leaving an estate consisting principally of real estate in Lincoln county described as the northwest quarter of section 33, township 15 north, range 2 east, being the property involved in this appeal, and leaving as his heirs at law -- Beatty, his wife, S.
