The defendant in error brought this suit against the Mexican Central Railway Company to recover damages for personal injuries. He with others were being transported over the road of the defendant company upon a freight train, under a contract of passage made with the company by his employer. There was a derailment of the train upon which he was being carried, and he was thereby injured. His relation to the company was that of a passenger. The train consisted of freight cars to which a caboose was attached, and he took his position upon a car which was loaded in part with…
