This matter is before this court upon the appeal of Cleveland Construction, Inc. (“Cleveland”), appellant, from the May 7, 1996 judgment entry of the Franklin County Court of Common Pleas. The history of this case is as follows: Cleveland is an Ohio corporation that submitted a bid to complete Phase I of a public works project known as the Max M.
