Badt, J.:

Defendants have appealed to this court from the judgment of the district court canceling a deed theretofore executed by the plaintiffs in favor of the defendants and settling the accounts of the parties growing out of the canceled transaction, and have also appealed from the order of the district court denying defendant’s motion for a new trial. The trial of the case was the second trial of the action — the judgment rendered in favor of plaintiffs in the first trial having been reversed by this court. Canepa v.
