MEMORANDUM AND ORDER
MURGUIA, District Judge.
Plaintiffs bring this action against defendant pursuant to the Employee Retirement Income Security Act (ERISA), 29 U.S.C. § 1001 et seq., and the Fair Labor Standards Act (FLSA), 29 U.S.C. § 201 et seq. Specifically, plaintiffs, as seminar presenters for defendant, allege they were improperly - classified as independent contractors and thus- denied benefits to which they were entitled under ERISA.
