THIS MATTER comes before the court following a non-jury trial on October 4, 1994. This case is a declaratory judgment action filed by the plaintiff, NationsBank of North Carolina, N.A., as Trustee for the Nations-Bank and Designated Subsidiaries Retirement Plan and Trust (“NationsBank”) against the defendant, Capital Associates International, Inc.
