OPINION

BASS, Justice.

This is an appeal from a conviction for the promotion of obscenity.

The judgment is reversed and the cause is ordered dismissed.

On August 13, 1980, Officers Hugo and Farrell of the Houston Police Department, Vice Division, made a routine investigation of the Cinema West Theatre for violations of the Texas Obscenity Laws. After paying the admission price the officers watched two movies entitled “Cry for Cindy” and “Sensational Jenine.” Officer Hugo recorded a description of each scene into a tape recorder.
