The writ of error in this case was returnable to the Court of Appeals. Counsel for the plaintiff in error moved that court to transfer the case to this court, upon the ground that that court was without jurisdiction to decide the case. The alleged lack of jurisdiction was based upon the ground that the second count of the petition made a case in equity, of which the Court of Appeals was without jurisdiction, and of which this court had jurisdiction, to decide the questions raised in the bill of exceptions.
