This litigation arose from a dispute among the owner, the contractor, and one of the subcontractors involved in the construction of a public housing project. On October 28, 1983, Allied Building Materials, Inc. d/b/a Allied Construction Company (hereinafter “Allied” or “the contractor”), contracted with the Housing Authority of the City of Rome (hereinafter “the housing authority”) to build the housing units for the fixed sum of $2,800,900.
