The plaintiffs brought suit to recover damages. Eor a clear understanding of the issues it is deemed well to set out the material portions of the petition, the demurrers, the plaintiffs’ amendment to the petition, and the demurrer to the petition as amended. Eirst, we quote from the petition, as follows: “The petition . . shows: . . (2) That your petitioners, on February 6th,, 1939, loaned to the defendant one sorrel mare mule, three years old, weighing about 1050 pounds to 1100 pounds. (3) That your petitioners are the owners of said described mule, described in paragraph 2 of the petition…
