DENNIS, Circuit Judge:

The plaintiff-appellant, Dalton M. Baskin, brought this action for civil damages under 26 U.S.C. § 7431 for alleged unauthorized disclosures of tax return information in violation of 26 U.S.C. § 6103. The district court granted in part and denied in part a motion for partial summary judgment filed by the United States, the defendant-appellee. Bas-kin appealed from that judgment insofar as the court held that a disclosure of information that was made on April 28, 1993 did not violate the terms of 26 U.S.C. § 6103. We affirm.
