Before the Court is defendants’ Motion to Dismiss and plaintiffs Motion for Class Certification. For the following reasons, the Court GRANTS in part and DENIES in part defendants’ motion. The Court also DENIES plaintiffs motion as premature.

I. Background

This case arises out of defendants’ alleged mishandling of plaintiffs confidential personal information. In 2006, plaintiff visited defendant Crescent City Tax Service, Inc., d/b/a Jackson Hewitt Tax Service (“Crescent City”), in Metairie, Louisiana to have her 2005 federal and state tax returns…
