WEINFELD, District Judge.

The defendant moves to vacate and set aside service of the summons and complaint.

The action was instituted by the plaintiff who is a Hungarian national, residing within the State of New York, under the Jones Act, 46 U.S.C.A. § 688.

The defendant is a Norwegian corporation and maintains no office in the State of New York or in the United States. It is the owner of the vessel “Ole Bull” upon which plaintiff claims he sustained the injuries for which he seeks to recover damages.
