FUNDERBURK, Justice.

By this suit Sam Poe, plaintiff, sought to recover from the Texas & Pacific Railway Company, defendant, a judgment awarding him damages for personal injuries sustained as the result of alleged negligence of the defendant. According to plaintiff’s petition, while he was in the performance of his duties as an employee of the defendant and was attempting to roll a heavy barrel upgrade on a sloping floor in a building containing certain materials and appliances, his foot slipped and the barrel rolled back, crushing his knee against the wall.
