MEMORANDUM-DECISION and ORDER

HURD, District Judge.

I. INTRODUCTION

Plaintiffs brought the instant action seeking a refund of all or a portion of the federal income and social security employment taxes paid by them when they received lump sum payments from their employer, International Business Machines Corporation (“IBM”), at the time of their separation from IBM’s employ. A previous motion to dismiss brought by the defendant United States was denied without prejudice to renew after the completion of discovery.
