MEMORANDUM OPINION
FABER, District Judge.
Pending before the court is defendants’ motion to dismiss. Plaintiff, Dr. Allan Gant (“Gant”), filed this action against his probation officer, Kenneth Sales (“Sales”); Sales’ supervisors; Dr. Sam Samples (“Samples”) and Davis Lewis (“Lewis”); and the United States Probation Office for the Southern District of West Virginia. Gant alleges that defendants superseded their authority in unilaterally altering the conditions of his supervised release and petitioning the court for a revocation hearing.
