MEMORANDUM OPINION AND ORDER
JACKSON, District Judge.
This matter comes before the Court on Plaintiffs and Defendant’s cross motions for summary judgment. On April 23, 1997. Plaintiffs AT&T Wireless PCS, Inc. (“AT & T”), PrimeCo Personal Communications, L.P. (“PrimeCo”), and Lynnhaven Methodist Church (“the Church”) filed a complaint alleging substantive and procedural violations of Section 704 of the Telecommunications Act of 1996 (“the Act”) by the Defendant, the City Council of the City of Virginia Beach (“the City Council”).
