MEMORANDUM OPINION AND ORDER
JACKSON, District Judge.
This matter comes before the Court on the parties’ cross motions for summary judgment. On July 22, 1997 Plaintiffs Virginia Metronet, Inc. (“Metronet”) and Donna Gris-som (“Grissom”) filed a complaint alleging that the Defendant, the Board of Supervisors of James City County (“the Board”), had violated Section 704 of the Telecommunications Act of 1996 (“the Act”) when it denied the Plaintiff Metronet’s request for a special use permit to construct a telecommunications tower on Plaintiff Grissom’s property in James City County.
