DEVIN, J., took no part in the consideration or decision of this case. The judgment of the clerk of the Superior Court fully sets forth the contentions of the litigants, and is as follows:

"This cause coming on to be heard upon motion of the defendant Sarah C. Stewart, made in behalf of herself and in behalf of all other legatees and devisees under the will of John W.
