The City of Kirkland issued a substantial development permit on November 1, 1971, authorizing construction of an all-weather moorage facility on Lake Washington. Acting under authority granted by the provisions of RCW 90.58.180, the Department of Ecology and the Attorney General of the State of Washington sought review of the matter by the Shorelines Hearings Board. RCW 90.58.180 directs that review proceedings by the board are subject to the provisions of RCW 34.04 pertaining to procedures in contested cases. The board convened a formal hearing and recorded the proceedings.
