This is an action for damages for personal injuries, brought by the plaintiff, Milton Morris, a minor, by his guardian ad litem, J. M. Morris, father of plaintiff, against the Standard Oil Company, a corporation.

The facts in the case are these: Plaintiff’s age at the time of the accident was thirteen years. He was riding a bicycle in a southerly direction on the west side of Imperial Avenue, north of Seventh Street, in the" city of Calexico, Imperial County.
