The plaintiff sued to recover damages for injuries suffered when he fell into an uncovered ditch excavated by the defendant along 101st Street near the town of Lennox in Los Angeles County. The jury returned a verdict for the defendant. The" plaintiff appealed from the judgment specifying as grounds for reversal prejudicial errors in the giving of certain instructions, in the refusal to give others, and in the admission of certain evidence.
