This case is before the court after argument on defendant’s motion to dismiss for lack of subject matter jurisdiction pursuant to RCFC 12(b)(1) or, alternatively, for failure to state a claim upon which relief can be granted pursuant to RCFC 12(b)(4). Plaintiffs’ bid protest challenges the Administrative Office of the United States Courts’ award of a contract to replace the electronic mail system used by the federal courts.
