Title VII of the Civil Rights Act of 19641 makes unlawful, practices, procedures, or tests that “operate to 'freeze’ the status quo of prior discriminatory employment practices.” Griggs v. Duke Power Co., 401 U. S. 424, 430. To this rule, § 703 (h) of the Act, 42 U. S. C. § 2000e-2 (h), provides an exception:
