CONNOR, District Judge.

The bill, answer, and evidence disclose the following case:

On February 11, 1921, defendant M. Hockfield was adjudged a bankrupt, and on February 24, 1921, plaintiff, H. G. Hedrick, was duly elected and qualified as trustee. On January 11, 1921, said M. Hockfield, being then and for some time prior thereto insolvent, together with defendant Mary Hockfield, his wife, executed to defendant Rosie Hock-field a deed conveying’ to her a house and lot in the city of Durham, described therein as “being the same lot mentioned and described in the deed from W.
