Habeas corpus. The facts in the above-entitled matter are stipulated to be as follows:
On or about the fifth day of June, 1924, petitioner, George Haines, was serving a sentence in the county jail of Shasta County, in the city of Redding, under conviction of a misdemeanor, to wit: malicious mischief, and in the custody of an officer, a deputy sheriff, and while engaged in going to county work escaped from the lawful custody of such officer.
