By the Court, Crockett, J.:

At the trial, the prosecution offered in evidence, as admission of guilt, a deposition made by the defendant on his examination before the committing magistrate. The defense objected to the evidence on the ground, amongst others, that the confession “was not free and voluntary, but was the result of threats made, and inducements held out to him prior thereto by the officers of the law, who had him in custody; and asked leave to introduce evidence in support of the objection.” The application was refused and the defendant excepted; and thereupon the deposition was…
