The plaintiff is the owner of the N. W. ^ of section 30, township 2 S., range 31 E., Willamette Meridian, in Harney *447County, Oregon, and is also the owner of a right of way for the maintenance of a water ditch leading from Silvies River across the northern part of the N. B. 14 of said section to a point near the northeast corner of his premises, for the purpose of conveying water to and upon such premises for irrigation and use of stock. The right of way was conveyed to plaintiff by defendant George W. Young by deed of date August 24, 1S93; he being then the owner of said N. B. 14 of section…
