This is an appeal by P. H. Mitchell from a judgment in favor of the Vulture Mining & Milling Company, a corporation, entered on a directed verdict granted upon motion of the defendant at the close of the plaintiff’s case.

The substance of the second amended complaint on which the case was tried is that in the summer of 1930 the Vulture Mining & Milling Company, a corporation, hereinafter called defendant, owned thirty-one mining claims, patented and unpatented, near Wickenburg, Arizona.
