The plaintiff commenced his action against the defendant upon an insurance policy, a copy being attached to the petition, for .an accounting and! judgment for the amoiunr: found due. A second action is based upon a contract, a copy of which is attached to the petition, entered into between Mcllree and Grier, and the Commercial ¡National .Bank of Oklahoma City, as trustee for the benefit of certain persons for whom the first parties should write policies of insurance in the defendant company.
