After working on the railroad as a locomotive engineer for 18 years, Phil Baker (“the decedent”) was stricken with nasopharyngeal cancer and died. The decedent’s widow, Linda W. Baker, brought an action, individually and as representative of her husband’s estate, against the decedent’s former employer, Norfolk Southern Railway Company (“Norfolk Southern”), alleging the decedent’s fatal cancer was caused by prolonged exposure to exhaust from Norfolk Southern’s diesel powered locomotives.
