This action was brought by William Keen and fifty-four others similarly situated against the City of Lafayette to recover a sum of money each claimant alleges is due him as the unpaid balance ■ of his salary as a member of the fire department of said city during the years 1933 to 1936, both inclusive. Issues were joined by an amended complaint and an answer in general denial together with special pleas of payment, waiver, estoppel and the alleged repeal of the ordinance upon which the appellees base their claims.
