Appellant, the City of Los Angeles, has appealed from a dismissal of its action to recover $50,407 against a real estate developer, respondent Gleneagle Development Company (hereafter Gleneagle), and its surety, respondent Security Insurance Company of Hartford (hereafter Security) for breach of contract to construct *549certain improvements which were conditions precedent to the city’s approval of subdivision tract maps. The dismissals were ordered pursuant to section 583, subdivision (a) of the Code of Civil Procedure for want of diligent prosecution.1
