MEMORANDUM AND ORDER

NEWCOMER, District Judge.

This is an action brought by three blacks who are former employees of defendant United States Steel and former* members of defendant United Steelworkers. The complaint alleges that defendants discriminated against plaintiffs on the basis of their race, in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq. and Section 1 of the Civil Rights Act of 1866, 42 U.S.C. § 1981.
