OPINION AND ORDER

HEWITT, Judge.

This matter comes before the court on the parties’ cross-motions for summary judgment pursuant to Rule 56 of the Rules of the Court *422of Federal Claims (RCFC). Plaintiffs assert that they are entitled to compensation under the Public Safety Officers’ Benefits Act, 42 U.S.C. § 3796 (1994) (PSOBA or the Act), and that the United States Department of Justice, Bureau of Justice Assistance (BJA), erred in denying their claim.
