Thomas Gallagher, Justice.

Action for $5,000 and interest by Joseph C. O’Donnell and Elizabeth A. O’Donnell against Continental Casualty Company on an accident insurance policy issued by said company upon the life of their brother, James J. O’Donnell, in which they were named as beneficiaries and which provided for payment of the sum of $5,000 in case of the accidental death of the insured. On September 25, 1956, *328the insured sustained injuries in an automobile accident from which he died the following morning.

Defendant did not deny liability on the policy but failed and refused to make payment…
