MEMORANDUM DECISION

GAGLIARDI, Senior District Judge.

In this diversity case defendant Inter-mare K.G., K.S. Kuhlschiff, K.m.b.H. and Co. (“Intermare”) moves the court for a directed verdict, a J.N.O.V., a new trial or a remittitur pursuant to Fed.R.Civ.P. 59. The case was tried to a jury which awarded plaintiff Bobby Burney (“Burney”) $257,-000 in damages for injuries he suffered while working as a longshoreman on the Nectarine, one of Intermare’s ships. For the reasons discussed below we deny the motion for a new trial, conditional upon plaintiff consenting to a remittitur in the amount of…
