This is an action for declaratory relief to determine the rights of the parties under a certain mining lease and option, and to secure the continued possession of the premises by the plaintiff. After a six-day trial, judgment was entered in favor of the plaintiff on December 11, 1946. After a motion to modify, a modified judgment was entered on January 13, 1947.
