PAUL H. ANDERSON, Justice.
Randy Pool was kidnapped and murdered in McLeod County in July 1999. Following the murder, petitioner Toby Earl Johnson was arrested and indicted for first-degree intentional murder while committing a kidnapping, second-degree intentional murder, and kidnapping. Pursuant to a plea agreement, the state amended the first count of the indictment to aiding and abetting a premeditated intentional murder.
